By accessing or using the Sculpturesly website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our website or services.

If you create an account with Sculpturesly, you are responsible for:

• All activity that occurs under your account, whether or not you authorised it
• Notifying us immediately at support@sculpturesly.com if you suspect any unauthorised use of your account

4. Products & Pricing

We take great care to present our sculptures accurately. However, please note:

• Product descriptions and images are provided for informational purposes and do not constitute a warranty
• All prices are displayed in EUR (€) and include applicable VAT unless otherwise stated
• We reserve the right to correct any pricing errors. If an error affects your order, we will contact you before processing
• Product availability is not guaranteed and items may be removed from the site at any time

5. Orders & Payment

When you place an order on Sculpturesly, it constitutes an offer to purchase. A contract is formed only when we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability.

All payments are securely processed through Stripe. We do not store your payment card details on our servers. By completing a purchase, you confirm that you are authorised to use the payment method provided.

6. Shipping & Delivery

Delivery times, shipping rates, and packaging details are outlined on our Shipping & Delivery page. Risk of loss or damage to products passes to you upon delivery. If your shipment arrives damaged, please refer to our returns policy.

7. Returns & Refunds

Returns and refunds are governed by our Returns & Refunds policy. You have a 30-day window from the date of delivery to initiate a return for eligible items. Please review the full policy for conditions, exclusions, and the return process.

8. Intellectual Property

All content on the Sculpturesly website — including but not limited to text, images, photography, logos, graphics, and software — is the property of Sculpturesly or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on this site without our prior written consent.

9. Limitation of Liability

The Sculpturesly website and its products are provided on an “as is” and “as available” basis. To the maximum extent permitted by law:

• Our total liability for any claim arising from your use of the site or a purchase is limited to the value of the order in question
• We are not liable for any indirect, incidental, consequential, or punitive damages
• We do not guarantee uninterrupted or error-free access to the website

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be submitted to the competent courts of the Netherlands. If you are a consumer residing in the EU, you retain the benefit of any mandatory consumer protection provisions in your country of residence.
